operated by Botaki Digital Holdings
(PTY) LTD (2026/351462/07) (“we,” “us,” or
“our”). By accessing or using our website, mobile application, and
premium services, you agree to be bound by these Terms and Conditions.}

_{1. Eligibility & Account Security}

Age Requirement: You must be at least 18
years of age to create an account and use the Platform. By using HEAT+, you
warrant that you have the legal capacity to enter into this agreement.}

Account Responsibility: You are
responsible for maintaining the confidentiality of your login credentials. Any
activity occurring under your account is your sole responsibility.}

_{2. Paid Memberships & Subscription Tiers}

Subscription Model: HEAT+ offers premium
membership tiers purchased for fixed durations (e.g., monthly). Subscriptions
do not auto-renew.}

Manual Renewal: To maintain uninterrupted
access to premium features, you must manually renew your subscription before
its expiration date.}

Expiration Notifications: As a courtesy,
the Platform will attempt to send you a renewal reminder notification
approximately two (2) days prior to the expiration of your current subscription
tier. However, it remains your sole responsibility to ensure your subscription
is renewed on time. HEAT+ is not liable for any loss of premium access,
features, or match connectivity due to missed or undelivered notifications.}

Refund Policy: In accordance with the
South African Consumer Protection Act (CPA), all manual premium tier purchases
are final and non-refundable once the service has been provisioned.}

Account Deletion & Lapsing: If you
voluntarily delete your account or profile before the end of your paid
subscription period, any remaining active days are immediately forfeited and will
not be pro-rated or refunded.}

Third-Party Application Stores: If your
premium tier subscription was purchased through an in-app purchase system (such
as the Apple App Store or Google Play Store), your transaction is additionally
subject to those respective platform terms. Any payment processing disputes or
billing inquiries must be managed directly through the applicable app store
account administration.}

_{3. User Conduct & Prohibited Behavior}

Prohibited Content: You may not post,
upload, or share any content that is sexually explicit, defamatory, abusive,
discriminatory, harassing, or that infringes on third-party intellectual
property rights.}

Community Safeguards: Creating fraudulent
profiles, impersonating others (“catfishing”), operating multiple
accounts, or utilizing the platform for commercial solicitation, promotion, or
escort services is strictly prohibited.}

Safety & Interaction: You are solely
responsible for your interactions with other users. HEAT+ does not conduct
criminal background checks on its users, though we reserve the right to do so.}

Assumption of Risk for Offline Meetups: HEAT+
is strictly an online connection platform. We do not organize, monitor, or
control real-life interactions or meetups between users. You acknowledge and
agree that any decision to meet another user in person is done entirely at your
own discretion and personal risk. HEAT+ assumes absolutely no responsibility or
liability for any harm, injury, loss, or distress (whether physical, financial,
or emotional) that may occur during or as a result of an in-person meeting.}

Termination & Bans: We reserve the
right to suspend, terminate, or permanently ban your account and device ID
immediately, without notice or refund, if you violate these terms or behave in
a manner we deem inappropriate or unsafe.}

_{4. Limitation of Liability}

_{To the fullest extent permitted by South African law, HEAT+ shall not be
liable for any indirect, incidental, special, or consequential damages
resulting from your use of the service or interactions with other users met
through the platform.}

personal information in accordance with the Protection of Personal Information
Act, No. 4 of 2013 (POPIA) of South Africa.}

Deletion Grace Period: If you choose to
close or delete your account, your profile and personal data will be held
securely in an inactive state for a period of exactly one (1) month (30
days). This grace period is provided solely as a courtesy in the event that
you wish to reactivate your account and restore your matches and subscription
status.}

Permanent Deletion: Upon the expiration
of this 1-month window, all your personal information, profile data, and media
will be permanently deleted or completely anonymized from our live databases,
unless retention is strictly required by South African statutory legal

By utilizing HEAT+, you acknowledge and consent
that your personal information may be transferred to, stored, and processed on secure
cloud infrastructure located outside of South Africa (internationally). We
ensure that any international third-party hosting facilities or data processors
maintain security standards and privacy protections that meet or exceed the
requirements set out under POPIA.}
